Three Year Limited Warranty
Optio Data (herein after referred to as Optio) warrants that the products purchased by end-user customers from Optio will be free from defects in materials and/or workmanship when in normal use for the period of three years from the date of purchase. This warranty is not transferable and applies to purchases directly by the end user within the United States and Canada. We reserve the right to exclude specific products from this warranty.
Date of purchase is defined as the shipment date from Optio. For the warranty period described above, Optio will provide replacement parts and materials necessary to maintain the warranted hardware in good operating condition. Product(s) serial number(s) must match our records for warranty to be honored. If Optio provides replacement parts and the defective product returned does not match our serial number records, customer hereby agrees to pay Optio for the product based on the original purchase price.
The customer must contact Optio first to initiate all warranty claims to determine what item(s) are covered under the Original Equipment Manufacturer (herein after referred to as OEM) and/or the Optio warranty. For products purchased from Optio with a manufacturer’s warranty, the manufacturer’s warranty will take precedence over the Optio warranty. At the customer’s request, Optio will help facilitate the OEM warranty process. Optio's remaining three year warranty will take effect after the OEM's warranty has expired. Should Optio, at Optio’s discretion, replace OEM warranted product on the customer's behalf, the customer will return the OEM provided replacement products to Optio.
Replacement parts do not extend the original warranty period. Replacement parts may be new, previously used or refurbished. Optio reserves the right to have the defective product(s) returned to us at no cost to the customer.
Parts service will be provided using remote diagnosis or other service delivery methods at Optio’s sole discretion. This warranty does not cover hardware or software installation or maintenance costs for the replacement product(s). For the first 120 days, the warranty is advance parts replacement. After 120 days, defective product(s) will be returned to Optio and repaired or replaced at no charge to the customer. At its discretion, Optio may repair or replace products (a) with new, refurbished or previously used products or parts equivalent to new in performance and reliability, or (b) with equivalent products to an original product that has been discontinued. Optio reserves the right to replace with equal or better technology without any incremental charges to the customer. Replacement parts are warranted to be free from defects for the remainder of the three year Warranty Period. All component parts or hardware products removed under this Limited Warranty become the property of Optio. Optio will pay for ground shipping related to return of the repaired or replaced product to the customer.
For products that contain a manufacturer's warranty, that warranty supercedes any warranty provided by Optio Data, expressed or implied.
This warranty does not cover any OEM or third party software, software licensing & support, ownership transfer fees, revision level or software compatibility issues. Tape drives, cache/controller batteries and consumable media purchased from Optio, the warranty is 120 days advance replacement. Extended warranty options are not available and do not apply to these products.
Optio does not warrant damages or defects to products purchased from Optio under the following conditions: acts of God, terrorism, abuse, neglect, accident, misuse, power fluctuations, usage of parts or components not supplied by Optio, unsupported components, shipping damage, failure to perform preventative maintenance, or damage caused by peripherals, software, viruses or from other external causes.
For Optio individual or loose (not integrated) part(s) purchased by entities that resell or transfer ownership of Optio products, or for Optio products purchased by and delivered to customers outside of the United States and Canada, the warranty is 30 days advance replacement. For complete systems, integrated technologies, the warranty is 90 days advance replacement with no other implied or expressed warranty.
This encompasses our entire warranty and is your exclusive remedy for defective products.
Extended Warranty Options
At Optio’s discretion, Extended Warranty options are available. Optio offers customers a multi-year “Advance Replacement Warranty” for parts that extend the advance replacement warranty beyond the original 120 day warranty period. Please refer to the extended warranty options on the “Quotation” page for extended warranty options and incremental charges.
The Advance Replacement option is available for the following brands: Cisco, Dell EMC, Hewlett Packard Enterprise, and Nimble. Other brands may be covered at Optio’s discretion.
To obtain service under the Optio warranty, the original owner must contact Optio with the part number and serial number of the product(s) within the warranty period. The product must be returned to Optio within 30 business days after the replacement product has been provided. After 30 days, the customer will be invoiced for the replacement product. The customer agrees to provide reasonable cooperation in order to facilitate and/or receive warranty services. Any replacement parts may be used or refurbished products or parts, or equivalent products to an original product that has been discontinued. The warranty period is not extended as a result of purchasing any additional parts/systems from Optio or upgrading the purchased systems. The customer is responsible for backing up data and operating system software before returning any products that may have proprietary information. Optio assumes no responsibility for lost data.
At its discretion, all replacement products must be returned to Optio. The customer is responsible for returning defective products using the original or comparable packaging and for safe transit of the product. Customer is responsible for payment of product(s) not returned to Optio. For warranty claims not protected under our Advance Replacement Warranty, the equipment will be treated as a depot repair which requires time to perform proper diagnostics including replacement of parts. With the exceptions noted above, this limited warranty shall only provide for parts replacement and depot repair for hardware purchased from Optio. Optio assumes no responsibility for equipment during shipment from customer to Optio or from Optio to customer, whether within or outside of the warranty period. For depot repairs not covered by warranty, customer is responsible for all labor, materials and shipping costs.
THE WARRANTIES SET FORTH HEREIN ARE IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESSED OR IMPLIED INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE. Optio DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE. EXCEPT FOR THE OBLIGATIONS SET FORTH IN THIS WARRANTY STATEMENT, Optio SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR LOSSES IN PROFITS, LOSS IN REVENUE, LOSS IN SAVINGS, LOSS OF DATA, DOWNTIME, COSTS OF CAPITAL, COSTS OF REPLACEMENT EQUIPMENT (TEMPORARY OR PERMANENT), COSTS OF TIME, THIRD PARTIES' CLAIMS OR INJURY TO PROPERTY.
